General Terms and Conditions of Sale (T&C)

1. Seller information

2. Scope

These General Terms and Conditions of Sale (hereinafter “T&C”) govern all purchases made through the ecommerce site kakilife.ch, operated by Z-Brand SAgl.

By placing an order, the customer declares that they have read and fully accept these T&C. The T&C may be updated at any time; the version in force at the time of the order shall apply.

3. Products

The images, descriptions, colours and characteristics of the products published on the site are provided for illustrative purposes only. We are committed to ensuring the highest accuracy of the information; however, small variations in shade, finish, packaging or construction details do not constitute a product defect and do not give rise to claims.

Product availability is subject to stock. In the event of unavailability arising after the order confirmation, the customer will be promptly informed and may choose between a full refund or waiting for the item to be restocked.

4. Prices

All prices are expressed in Swiss francs (CHF) and are inclusive of Swiss VAT at the rate provided for by law.

Shipping costs are shown separately during the checkout process, before the final order confirmation.

We reserve the right to change prices at any time. The price applied to the order is the one displayed at the time of confirmation.

5. Orders and conclusion of the contract

The order placed by the customer constitutes a contractual offer. The sales contract is considered concluded only upon our sending of the order confirmation by email.

We reserve the right to refuse or cancel orders, even after the confirmation has been sent, in the following cases:

  • incomplete or inaccurate information provided by the customer;
  • reasonable suspicion of fraud or improper use of the service;
  • subsequent unavailability of the product;
  • manifest error in the price or description of the product;
  • impossibility of delivery to the indicated address.

In the event of refusal or cancellation, any amount already charged will be fully refunded.

6. Payments

We accept the payment methods indicated on the site during the checkout process. Payment is processed through secure and certified payment service providers.

Z-Brand SAgl does not store payment data (card numbers, CVV) on its servers: these are processed directly by the payment providers, in accordance with PCI-DSS standards.

The charge is made at the time of order confirmation. If the payment fails, the order is automatically cancelled.

7. Shipping and delivery

Deliveries are made exclusively within Swiss territory (and the Principality of Liechtenstein, where applicable).

Delivery times indicated on the site are estimated and not guaranteed, unless otherwise agreed in writing. Delivery is carried out through our reference logistics partner.

We are not responsible for delays attributable to:

  • carriers and couriers;
  • customs operations (where applicable);
  • force majeure events (natural disasters, epidemics, acts of authority, etc.);
  • strikes or unforeseeable logistical problems;
  • incorrect or incomplete delivery addresses provided by the customer.

The risk of loss or deterioration of the goods passes to the customer at the time of delivery.

8. Right of return

Swiss legislation does not provide for a mandatory right of withdrawal for online purchases. However, we voluntarily offer the following return policy:

  • the customer may request a return within 14 days of receipt of the goods;
  • the product must be returned unused, intact and in its original packaging, complete with all accessories and documentation;
  • return shipping costs are borne by the customer, except in the case of an incorrect or defective product attributable to the seller;
  • the return request must be communicated in advance by email to info@kakilife.ch, indicating the order number.

Refunds are processed within 14 business days from approval of the return, using the same payment method used for the purchase.

The following items are excluded from the right of return:

  • products opened, used or damaged by the customer;
  • personalised or made-to-order products;
  • perishable items, hygiene products or live plants.

9. Warranty

The warranties provided for by Swiss law apply (Art. 197 et seq. of the Swiss Code of Obligations). The customer is required to inspect the goods at the time of receipt and to report any apparent defects within 5 days of delivery, by email to info@kakilife.ch.

Hidden defects must be reported immediately upon discovery. In the event of a recognised defect, the customer is entitled, at our choice, to replacement of the item, repair or refund of the price.

10. Liability

Z-Brand SAgl’s liability is limited to cases of wilful misconduct or gross negligence, within the limits permitted by Swiss law.

In particular, we are not responsible for:

  • indirect or consequential damages;
  • loss of profit, data or business opportunities;
  • improper use of the products by the customer or third parties;
  • damages arising from modifications or alterations to the product.

11. Data protection

The processing of personal data is carried out in accordance with the Swiss Federal Act on Data Protection (FADP) and EU Regulation 2016/679 (GDPR), where applicable. For more information, please refer to the Privacy Policy published on the site.

12. Intellectual property

All content on the site (texts, images, trademarks, logos, graphics, code) is the property of Z-Brand SAgl or the respective owners and is protected by intellectual property laws. Any reproduction, even partial, without written authorisation is prohibited.

13. Applicable law and jurisdiction

These T&C and any contractual relationship between the customer and Z-Brand SAgl are governed exclusively by Swiss law, excluding the rules of private international law and the Vienna Convention on the International Sale of Goods.

The exclusive jurisdiction for any dispute is the court of Chiasso, Canton of Ticino, subject to the mandatory jurisdictions provided for by law for the protection of consumers.

  • couriers and logistics partners (for the delivery of orders);

Z-Brand SAgl does not sell personal data to third parties.

Any transfers of data outside Switzerland or the European Economic Area take place only to countries that guarantee an adequate level of protection, or on the basis of standard contractual clauses.

In accordance with the FADP and, where applicable, the GDPR, the user has the right to:

  • request the rectification of inaccurate or incomplete data;
  • request the deletion of data (right to be forgotten), within the limits of the law;
  • object to processing on legitimate grounds;
  • withdraw at any time the consent given;
  • request data portability, where applicable;
  • lodge a complaint with the competent supervisory authority (FDPIC in Switzerland).
